The National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC , NFL International LLC and each of their respective direct and indirect subsidiaries, affiliates, owners, shareholders, officers, directors, agents, representatives and employees (collectively, The “NFL Entities”) shall have no liability or responsibility for any claim arising in connection with participation in this promotion, use of this mobile membership card and/or participation in any contest or sweepstakes associated therewith or prize awarded in connection therewith. The NFL Entities have not offered or sponsored this promotion in any way.

1. The Gateway Gridiron Football Club is a promotional membership rewards program offered through Gateway’s My Club Eat and Drink promotional program. No purchase is necessary to participate in the Gateway Gridiron Football Club. Membership in the Gateway Gridiron Football Club expires on February 21, 2023.
2. To be eligible to become a Member in the Gateway Gridiron Football Club, a patron must complete the Gateway Gridiron Football Club application form online. There is no fee payable to obtain membership in the Gateway Gridiron Football Club. To participate in the Gateway Gridiron Football Club, a Member must comply with these terms and participation in the Gateway Gridiron Football Club is acceptance of these terms and conditions.
3. In order to be eligible to become a Member in the Gateway Gridiron Football Club, a patron must be 18 years of age or older in Alberta, or 19 years of age or older in British Columbia or Ontario. Applicants are not eligible to participate in the Gateway Gridiron Football Club if they are self-excluded, suspended or banned from attending at a casino property in British Columbia, Alberta or Ontario. Applicants who are currently employed by or contracted by Gateway Casinos & Entertainment Limited (Gateway) or its affiliates, or employed by or contracted by any corporation responsible for the conduct and management of gaming in a province, are not eligible for Membership in the Gateway Gridiron Football Club.
4. Membership in the Gateway Gridiron Football Club is granted and maintained at the sole and absolute discretion of Gateway.
5. The Member undertakes to notify Gateway of any change in personal information as soon as possible, by identifying themselves in person at a Guest Services booth and presenting at least one piece of government-issued identification.
6. Gateway, in its sole and absolute discretion, reserves the right to limit the Member’s participation in any rewards, benefits and/or promotions offered through the Gateway Gridiron Football Club at any time during membership.

BENEFITS & REWARDS

7. Upon presentation at a participating Gateway property of a valid Gateway Gridiron Football Club membership card and any other government-issued identification as may be required and accepted by Gateway, in its sole discretion, Members are eligible to receive a 20% discount on the participating property’s Game Day Menu. The Gateway Gridiron Football Club Card may be used in conjunction with a Member’s Encore Rewards card, as applicable and in accordance with the terms applicable to the Encore Rewards program.
8. Upon the issuance of a Gateway Gridiron Football Club membership card, Members are automatically entered into the Gateway Gridiron Football Club season-long “Super Fan” promotion for a chance to win the Ultimate Super Fan prize (the Grand Prize). The odds of winning the Grand Prize depend on the number of Gateway Gridiron Football Club members.
9. The Grand Prize will be drawn by Gateway at 10 pm PST on January 23, 2023. The number of eligible entries will be counted and the number of eligible entries are counted and each eligible entry will be given a unique number from 1 to ‘x’ where ‘x’ is the total number of eligible entries. A random number will be calculated within the range of 1 to ‘x’ using standard computer code. The eligible entry whose unique number matches the random number will be selected as the eligible prize winner (the Drawn Entrant).
10. Gateway will contact the Drawn Entrant by email at the email address provided on the Gateway Gridiron Football Club application form. The Drawn Entrant will have 24 hours to respond to the email and claim the Grand Prize. If the first Drawn Entrant is not able to claim the prize, steps 1-4 are repeated until a Drawn Entrant is able to claim the Grand Prize.
11. One Grand Prize will be awarded to the Drawn Entrant. The Grand Prize will have a minimum value of $1000 in NFL and Budweiser prizing.

MEMBERSHIP CARDS

12. Upon acceptance by Gateway of an application for Membership in the Gateway Gridiron Football Club, one Gateway Gridiron Football Club Card displaying the Member’s name and a unique membership number will be issued to the Member. Use of the card constitutes acceptance of these terms and conditions. A Member’s Gateway Gridiron Football Club Card expires on February 21, 2023. At all times during the Membership and after its expiry, the Gateway Gridiron Football Club Card and the unique membership number assigned to the Member remain the property of Gateway.
13. Gateway Gridiron Football Club Cards are not redeemable for cash.
14. It is the sole responsibility of the Member to safeguard their Gateway Gridiron Football Club Card and take precautions against loss, destruction, or unauthorized use of their Card.
15. Memberships in the Gateway Gridiron Football Club are not transferrable and the Gateway Gridiron Football Club Card may not be used by any person other than the Member to whom the Gateway Gridiron Football Club Card has been issued. Misuse of the Gateway Gridiron Football Club Card can result in account suspension at the sole discretion of Gateway.
16. Gateway reserves the right, in its sole discretion, to deny any application for membership and to revoke membership at any time. A Gateway Gridiron Football Club Card must be returned at the time of revocation. Gateway makes no representations or warranties, express or implied, with regard to the Gateway Gridiron Football Club Card, including any warranty of merchantability, fitness for a particular purpose title, non-infringement or that the Gateway Gridiron Football Club Card will always be accepted. Gateway shall not be liable for any loss or damage, however caused, suffered by any person as a result of the use or misuse of a Gateway Gridiron Football Club Card.

LOST OR STOLEN CARDS

17. In the event that a Member’s Gateway Gridiron Football Club Card is lost or stolen, the Member must immediately report the loss or theft to Gateway.
18. Gateway may replace a Gateway Gridiron Football Club Card at its discretion. Gateway reserves the right to charge a reasonable fee for replacement of a Gateway Gridiron Football Club Card, or to cancel a membership in the Gateway Gridiron Football Club if a Member, in the Gateway’s sole opinion, has claimed an excessive number of lost, damaged and/or stolen cards, or misused the Gridiron Card.
19. Members must present at least one piece of government-issued identification in order to obtain a replacement Gateway Gridiron Football Club Card.

PRIVACY

20. The Member authorizes Gateway to collect, hold, use, disclose and transfer personal information concerning the Member in accordance with these terms and conditions or otherwise as permitted by law. Such information may include the Member’s name, address, date of birth, telephone number(s), email address, identification details, and any other information relating to the Member which has been collected by Gateway or its affiliates by any means including but not limited to information collected in connection with the Gateway Gridiron Football Club. The Member agrees and acknowledges that some or all of such personal information concerning the Member may be stored in servers outside of Canada, including, but not limited to, in the United States.
21. Gateway and/or its affiliates may be required by law to collect personal information concerning the Member pursuant to various legislative enactments, included but not limited to those dealing with casino control, financial transaction reports, taxation and occupational health and safety.
22. The Member authorizes Gateway to collect, hold, use, disclose and transfer personal information concerning the Member in accordance with these terms and conditions or otherwise as permitted by law. Such information may include the Member’s name, address, date of birth, telephone number(s), email address, identification details, and any other information relating to the Member which has been collected by Gateway or its affiliates by any means including but not limited to information collected in connection with the Gateway Gridiron Football Club. The Member agrees and acknowledges that some or all of such personal information concerning the Member may be stored in servers outside of Canada, including, but not limited to, in the United States.
    •     (a) for marketing, planning, product development and other commercial purposes;
    •     (b) to comply with a lawful request including a request contemplated by clause 5.2 of these Rules;
    •     (c) as permitted or required by any law including any applicable privacy legislation in force and as amended from time to time; and
    •     (d) for any activities related to or consequent upon the above,
    and for the purposes of the above may disclose all such information to other parties who are acting on behalf of or in conjunction with Gateway or its affiliates, provided always that such information is only used in a manner contemplated by these terms and conditions or as otherwise permitted by law.
23. The Member acknowledges and agrees that Gateway may contract for any third party (including an affiliate) to carry out any of the functions which Gateway is authorized to carry out under these terms and conditions and may disclose a Member’s personal information to such entities for any purpose contemplated by these terms and conditions.
24. For the avoidance of doubt, if a Member, on his or her Gateway Gridiron Football Club application form, has indicated that he or she consents to Gateway and/or its affiliates providing that Member with material (including, for example and without limitation, “mail”, “regular communications” ,“promotional material” and “offers in connection with gaming and related activities”) (Promotional Material), that Member authorizes and consents to Gateway and its affiliates providing that Member with Promotional Material (including offers) in connection with all products and services offered by or on behalf of Gateway and/or its affiliates including gaming. The Member may, at any time, elect to opt-out of receiving any further direct marketing communications by writing to Gateway at the address provided on the Gateway Gridiron Football Club application form.
25. If a Member has any questions or inquiries relating to Gateway’s privacy practices or procedures, or if the Member believes that the personal information that Gateway holds about the Member is not accurate, complete or up to date, the Member may write to Gateway’s privacy office at the following address: info@gatewaycasinos.com.
26. Gateway may, at its sole discretion and without liability to any person, alter, amend, suspend or cancel the operation of the Gateway Gridiron Football Club or cease to operate the Gateway Gridiron Football Club at any time without notice.

GENERAL

27. No purchase is necessary to participate in the Gateway Gridiron Football Club.
28. Gateway reserves the right to not to award or offer any prize or benefit offered through the Gateway Gridiron Football Club, including the Grand Prize, in the event that the integrity or administration of the Gateway Gridiron Football Club rewards and benefits is compromised (including, but not limited to, due to computer error, fraud, deception, misrepresentation or misuse).
29. Gateway shall have the right to publish the name, location and a recent photograph of the Drawn Entrant without remuneration to them.
30. Gateway makes no representations or warranties whatsoever, either expressed or implied, oral or written, in respect to any reward, benefit or prize offered through the Gateway Gridiron Football Club.
31. Gateway is not responsible for any typographical errors in the administration of the Gateway Gridiron Football Club and/or in any promotion related materials.
32. By participating in the Gateway Gridiron Football Club all Members agree to release, discharge, indemnify and hold harmless the Gateway, the British Columbia Lottery Corporation and the Ontario Lottery and Gaming Corporation, and each of them and their respective affiliates, directors, officers, agents and representatives (collectively, the Releasees) from any and all liabilities, claims, damages, demands, actions or causes of action whatsoever which they or their heirs, successors, assigns, executors or administrators may now or hereafter have directly or indirectly against the Releasees or any of them in respect of or relating to the Gateway Gridiron Football Club the Members’ participation in the Gateway Gridiron Football Club and/or the acceptance or use, misuse or possession of any benefit or reward.
33. All prizes, rewards and benefits offered through the Gateway Gridiron Football Club must be accepted as awarded and are non-transferable. The refusal by a Member to accept any prize releases and forever discharges Gateway from all obligations to that Member in respect of the reward, benefit or prize.
34. Gateway reserves the right to substitute any reward, benefit or prize or portion thereof with one of equal or greater value.
35. All Gateway decisions in relation to the Gateway Gridiron Football Club are final and binding.
36. Gateway reserves the right to amend or materially alter the Rules at any time without notice.
37. The Member agrees to be bound by any amendment from the date the Operator specifies that the amendment comes into force. An up-to-date copy of the Rules is available for inspection at any Guest Services booth.
38. In the event of any inconsistency between any other document brought into existence for the purposes of the Gateway Gridiron Football Club and these Rules, these Rules shall prevail.
39. Whilst all reasonable care is taken to ensure that information, publications and advertisements supplied or provided in connection with the Gateway Gridiron Football Club is accurate, the Operator does not accept liability for any errors or omissions (including negligence) in such information, publications and advertisements, whether written or oral.
40. All decisions by the Operator in relation to the Gateway Gridiron Football Club and disputes in connection therewith are final and binding.
41. The Gateway Gridiron Football Club and these terms and conditions shall be governed by and construed in accordance with the laws of the province of British Columbia, and the federal laws of Canada applicable therein. If any provision of these terms and conditions is determined by a court of competent jurisdiction to be invalid, illegal or unenforceable in any respect, such determination shall not impair or affect the validity, legality or enforceability of the remaining provisions. To the extent that any provision is found to be invalid, illegal or unenforceable, a new provision will be substituted for such provision with content and purpose as close as possible to the provision so determined to be invalid, illegal or unenforceable.
